FAT DADDY'S BOUNCE HOUSE RENTALS — RENTAL AGREEMENT, ASSUMPTION OF RISK & LIABILITY WAIVER EQUIPMENT LIMITS: Maximum 6 participants, 800 lb combined, 180 lb maximum per participant, minimum age 3. Renter agrees to follow all manufacturer labels, instructions, capacity limits and operating requirements. If a manufacturer's posted limit is more restrictive, the posted limit controls. ASSUMPTION OF RISK: I understand that use of inflatable amusement equipment, including bounce areas, slides, climbing areas, obstacle features and wet/dry features, involves inherent risks including falls, collisions, slips, equipment movement and other injuries, including serious injury. I voluntarily assume the risks associated with use of the rented equipment by myself, my guests and participants, to the fullest extent permitted by North Carolina law. RELEASE AND WAIVER: To the fullest extent permitted by North Carolina law, I release and hold harmless Fat Daddy's, its owners, employees and agents from claims for bodily injury or property damage arising from ordinary negligence in connection with the rental, delivery, setup, operation or use of the equipment. This agreement is not intended to waive any right or claim that cannot legally be waived. RENTER'S RESPONSIBILITY & SAFETY RULES: A responsible adult age 18 or older must continuously supervise the inflatable whenever it is operating. The inflatable may not be moved, repositioned, unanchored, altered or disconnected after Fat Daddy's has installed it. Participants must obey all posted manufacturer age, weight and occupancy limits. No flips, wrestling, rough play, climbing on exterior walls, hanging from netting or other unsafe behavior. No shoes, sharp objects, food, drinks, gum, pets or items that could injure participants or damage the inflatable. Participants of substantially different sizes should be separated when simultaneous use would create an unsafe condition. No person under the influence of alcohol or drugs may use or supervise the inflatable. The blower must remain properly connected and operating. If power fails or the inflatable loses pressure, everyone must exit immediately. Water may be used only when the rental is authorized and set up for WET use. WEATHER & WIND: Renter will immediately stop use and evacuate the inflatable during lightning, thunderstorms, dangerous wind, heavy rain or any other unsafe condition. The inflatable must never be operated above the manufacturer's permitted wind limit. Fat Daddy's may require shutdown whenever conditions are considered unsafe. DAMAGE / MISUSE: Renter is financially responsible for damage caused by intentional damage, misuse, unauthorized moving, pets, sharp objects, prohibited substances or failure to follow instructions, excluding ordinary wear and tear. INDEMNIFICATION: To the fullest extent permitted by North Carolina law, renter agrees to indemnify and hold harmless Fat Daddy's from third-party claims resulting from renter's failure, or the failure of persons under renter's supervision, to follow safety instructions or from unauthorized or improper use of the equipment. ACKNOWLEDGMENT: I acknowledge that I have inspected or had an opportunity to inspect the equipment after setup. I have received and understand the operating and safety instructions and agree to enforce them. I understand that this agreement contains an assumption of risk and release of liability and that by signing I may be giving up certain legal rights.
